Customer

The person, firm or company booking the training and/or enrolling delegates on the training.  The Customer is responsible for payment for the Event. 

Delegate

A person attending the Event who may also be a Customer.   

Event

Any course including virtual, e-learning or in-person training:    

  • virtual training – a course delivered online via Zoom, Microsoft Teams or other virtual platform 
  • e-Learning – a training course delivered online via Learn Upon or other e-learning platform 
  • in person training – a course delivered at a designated venue   

IPSEA

Independent Provider of Special Education Advice 

Materials

Any training documentation that can be viewed on screen or printed out.  

Working day

Any day from Monday to Friday (inclusive) which is not a statutory bank holiday in England.

1. Orders and Acceptance

1.1 Customers and Delegates are deemed to accept these terms and conditions when booking an Event.  Customers will be responsible for the accuracy of all the details submitted. 

1.2 These terms govern the booking, payment and attendance at the Event to the exclusion of any terms and conditions of the Customer. 

2. Fees and Payments

2.1 Prices for Events are shown on our website but may be subject to increase. 

2.2 Save for a commissioned Event, the price for an Event is for a single DelegateA link to access a place at a virtual training event should not be shared with any other person nor should the Event be broadcast in front of any other persons live or subsequently without purchasing further Delegate places.   

2.3 Prices for in-person commissioned Events are exclusive of trainer travel expenses. These expenses will be calculated at the time of booking and added to the invoice. 

2.4 Cleared payment must be made within seven working days of securing an Event placeIf a place at an Event is secured less than seven working days before the date of the Event payment must be made immediately (this does not apply in the case of commissioned events, please refer to paragraphs 2.7 and 2.8). Payment should be made by debit, credit card or PayPal via our website online booking platform. Where invoices are requested paragraph 2.4 does not apply - please refer to paragraph 2.6 

2.5 IPSEA reserves the right to refuse admission / cancel an Event for any failure by a Customer to provide cleared funds in accordance with paragraph 2.4 above.  

2.6 Invoices are available and should be requested at the time of booking if required. Payment of an invoice must be made 30 days from date of invoice or seven working days before the Event whichever is sooner. Should payment not be received by that date a Delegate may still attend the training if IPSEA is provided with proof of payment or remittance at least seven working days before the Event. Should payment or proof of payment not be received seven working days before the Event, the Delegate’s place will be cancelled and full payment will still be charged. This does not apply to commissioned events, please refer to paragraphs 2.7 and 2.8 for terms and conditions associated with commissioned events.  

2.7 Where a Customer has commissioned an Event or a bespoke Event (a training course not published in our standard course brochure) clauses 2.4 and 2.6 do not apply. Payment of the invoice for the commissioned or bespoke Event must be made in full (or proof of payment or remittance supplied) no later than 4 weeks before the Event date. Should payment (or proof of payment or remittance) not be received by that date it will be treated as having been cancelled. In this situation please refer to paragraphs 3.5 and 3.8 below. If a commissioned or bespoke Event date is secured less than 4 weeks before the date of the Event then payment must be made immediately. 

2.8. We will not commence working on the course content in respect of bespoke Events until payment has been made.  

2.9 Invoices can be supplied after payment has been made but this is at the discretion of IPSEA. 

2.10 If a purchase order is required by the Customer before the issue of an invoice by IPSEA this purchase order must be supplied at the time of booking. The supply of a purchase order will not secure a place for a delegate at an Event or be taken as payment. Following receipt of a purchase order an invoice will be issued that must be settled in accordance with paragraphs 2.6 to 2.7 above. 

2.11 Customers will have a period of six months from the date of purchase to complete each e-Learning course. After this date access to the course and the e-Learning platform will be terminated. Customers can apply for an extension of time to complete their course but these will only be granted in exceptional circumstances. 

2.12 All customer and course data for virtual and in person training will be deleted 3 years after the date of the course. For eLearning courses, accounts that have not been accessed in the last 18 months will be deleted with data being retained for a maximum of 3 years after registration.   

3. Cancellations

3.1 IPSEA reserves the right to cancel, postpone or otherwise alter the content or date of an Event without notice. In such circumstances IPSEA may if available offer an alternative dateRefunds of any Event price paid (save for any commissioned Event) will be made in accordance with paragraph 3.4 below.  

3.2 In the event of cancellation by a Customer cancellation fees for all types of Events (save for any bespoke Event) will be due as follows: 

3.2.1 If a Customer cancels their attendance at a virtual Event between six and 15 working days before the date of the training then 30% of the Event price will still be payable. 

3.2.2 If a customer cancels their attendance at a virtual Event five working days or less before the date of the training then 100% of the Event price will be payableA place at an alternative Event will be offered only if the cancellation is due to illness or an emergency. IPSEA has the right to refuse a transfer to an alternative date 

3.3 A request for transfer to an alternative date can only be made once per booking and must be requested 15 working days or more before the Event. A transfer will not be accepted after 15 working days before the Event, apart from in accordance with paragraph 3.2.2 above. 

3.4 To request a refund in accordance with paragraphs 3.1 or 3.2 above you must notify IPSEA in writing by email to [email protected]. You will then be entitled to a refund from IPSEA which will be paid as soon as possible but no later than 20 working days. 

3.5 If a commissioned or bespoke Event is cancelled without re-booking the Event four weeks or less before the Event 100% of the price will be payable if still due. If a cancellation is requested without re-booking the Event more than four weeks before the Event a charge may still be applicable 

3.6 If a commissioned Event is cancelled more than four weeks before the Event date an alternative date can be arranged 

3.7 If a refund or a cancellation sum becomes due to a Customer IPSEA reserves the right to deduct any processing fees payable by IPSEA prior to the payment of the refund or cancellation sum due to the Customer.  

3.8 A refund may not be possible in the event of cancellation by a Customer of a commissioned or bespoke Event where payment has already been made.  

3.9 No refunds will be made in relation to e-Learning courses where the course has been accessed by a Customer. Where a Customer has purchased a package of e-Learning courses a refund may be available for any un-accessed courses after deducting the full cost of the accessed course(s). 

4. Substitutions 

4.1 Save for e-Learning courses substitute Delegates will be accepted, subject to prior notification to IPSEA. Where possible Customers should inform IPSEA of the alternative Delegate's name at least three working days before the date of the Event. No charge will be made for any substitution.   

4.2 The Event price per Delegate entitles one Delegate to view the Event in private and receive any Materials. Delegates should not share log in details, broadcast the Event or share Materials.   

5. Force majeure 

5.1 IPSEA will not be liable for any failure or delay in the delivery of the Event caused by circumstances beyond its reasonable control. Where this occurs IPSEA’s obligations will be suspended as long as such circumstances continue or the Event may be cancelled in which case paragraph 3 will apply.  

6. Copyright

6.1 IPSEA reserves all rights in the content of all Events and Materials. By accepting these terms Customers and Delegates acknowledge that all rights in the content of Events and Materials shall be owned by IPSEA and that in attending an Event, Customers and Delegates will not obtain any rights whatsoever in such content or Materials. 

6.2 Customers and Delegates agree not to reproduce, sell, hire or copy Materials (in whole or part) and not to use such Materials except for the purpose of individual post Event reference.

6.3 IPSEA does not record any Events without prior permission. Customers and Delegates agree not to audio or video record an Event or any part of an Event using any recording device. 

7. Data protection

7.1 Details of the Customer and Delegate will be added to IPSEA’s records to allocate a place at the EventAll data is processed in accordance with IPSEA’s privacy policy that is published on IPSEA’s website.  

7.2 Customer and Delegate data may be retained to keep them up to date with the services IPSEA offersChanges can be made at any time by notifying IPSEA by post or email at [email protected] 

7.3 e-Learning data will be deleted in accordance with paragraph 2.12 above. 

8. Miscellaneous

8.1 IPSEA training is not accredited. Attendance at an IPSEA Event or completion of an IPSEA e-Learning course does not entitle any Delegate to claim that they have been ‘IPSEA trained’ or are ‘IPSEA accredited’ nor should any Delegates use any other phrase or wording that implies that IPSEA endorses them and/or the Customer. 

8.2 If you have any additional requirements due to a disability or any other reason, please notify IPSEA to discuss these requirements as soon as possible but at least five working days prior to the Event. Whilst every effort will be made to accommodate any additional requirements, this cannot be guaranteed if no prior notice is received. 

8.2 IPSEA will not be liable for any travel or other expenses incurred by Delegates attending Events. 

8.3 IPSEA reserves the right to refuse admission to the Event to any Delegate whom it considers in its absolute discretion to be unsuitable for admission or to remove any such Delegate after the commencement of the Event. In these circumstances a refund will not be provided. 

8.4 IPSEA reserves the right to remove a Delegate from the Event whether online or in-person without providing a refund should that Delegate in the opinion of IPSEA show hostility towards the trainer(s) and other Delegates. 

8.5 For in-person commissioned Events, Customers must complete and return a pre-training form provided by IPSEA in full at least four weeks prior to the Event.
