Most judicial reviews about a child’s education will be in the child’s own name (not yours as their parent). Your child is highly likely to be financially eligible for legal aid, meaning you would not have to pay for legal support to take their case to court. But, there is a set process which must be followed before a judicial review goes to court, known as the “pre-action” stage. To access funded legal help for this, a parent has to qualify for legal aid in their own right.
